Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by Probix Intelligence (“Probix”, “we”, “us”). By creating an account or using our service, you agree to these Terms. If you are entering into these Terms on behalf of a business, you represent that you are authorized to bind that business.

1. The service

Probix provides a call-answering, booking, and customer follow-up service for home service businesses. The service answers inbound calls on your behalf, books appointments to your calendar, sends confirmations and reminders, follows up on quotes and invoices, and requests customer reviews. Features available to you depend on the plan you select.

2. Accounts

You are responsible for the information you provide during onboarding, for keeping your account credentials secure, and for all activity under your account. You agree to provide accurate, current, and complete information.

3. Subscriptions, billing, and payment

The service is billed on a recurring monthly subscription based on the plan you choose. Payments are processed by our authorized reseller and Merchant of Record, Paddle.com, which handles billing, applicable taxes, and invoicing. By subscribing, you also agree to Paddle’s buyer terms. Subscriptions renew automatically each month until cancelled. Usage beyond your plan’s included talk minutes may incur overage charges at the rate shown for your plan.

4. Cancellation

You may cancel your subscription at any time with 30 days’ notice by emailing founder@probixai.com. Your service remains active through the end of your current billing period. Refunds, where applicable, are governed by our Refund Policy.

5. Your responsibilities and acceptable use

  • You are responsible for obtaining any consents required to record calls and to contact your customers by call or text, and for complying with all applicable laws, including telemarketing, call-recording, and consumer-protection rules (such as the TCPA) in the jurisdictions where your customers are located.
  • You will not use the service for unlawful, deceptive, abusive, or harassing purposes, or to send messages to people who have not consented to be contacted.
  • You will not attempt to disrupt, reverse-engineer, or gain unauthorized access to the service.

6. Service availability

We work hard to keep the service running reliably, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, update features, or modify the service from time to time.

7. Intellectual property

The service, including its software, content, and branding, is owned by Probix and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these Terms. Data and content you provide remain yours.

8. Disclaimers and limitation of liability

The service is provided “as is” without warranties of any kind, to the maximum extent permitted by law. To the extent permitted by law, Probix will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim will not exceed the amount you paid us in the three months before the claim arose.

9. Termination

We may suspend or terminate the service for violation of these Terms, non-payment, or unlawful use. You may stop using the service at any time as described in Section 4.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the service or by email, and continued use after changes take effect constitutes acceptance.
